Child Custody in Qatar After Divorce: Ages, Sponsorship and Travel
Quick answer
Qatari courts decide custody under Family Law No. 22 of 2006 and Sharia, whatever the parents' religion. The UK government's guide says a Muslim mother has custody of sons to age 13 and daughters to 15, and a non-Muslim mother to age 7. A custodian mother may travel with her children if it does not harm them, and a foreign mother's sponsor may be asked to guarantee her return.

Custody after a divorce is not the same as guardianship, and in Qatar they can sit with different parents. That is what causes most travel and residence problems for expat families. This guide uses the UK government's family law page (updated 20 April 2026), an abstract of Articles 177 and 185 of the Family Law, and a search summary of related commentary. We could not read the full law, and this is general information, not legal advice. Talk to a Qatar family lawyer about your own case.

Who gets custody?

The UK page says Qatari courts decide custody disputes under Sharia regardless of religion. A mother has priority if the parents separate, unless a judge decides otherwise in the child's interest. It lists the order of custodians: mother, father, paternal grandmother, maternal grandmother, then other relatives. A custodian must be a mature adult of sound mind who is honest and able to care for the child. For a child of the opposite sex, the custodian must be a mahram.

Until what age?

The same page says a Muslim mother has custody of sons until 13 and daughters until 15, unless a court rules otherwise, and a non-Muslim mother has custody until 7, but only if she raises the children as Muslims. These age limits come from one embassy summary of an unofficial translation, so check the current law with a lawyer.

Guardianship is different

The UK page says there are no clear laws on guardianship of foreign nationals, and that guardianship and protection of minors are governed by the father's nationality law. A search summary also reported a case where custody went to the wife and guardianship to the husband. That split is what leads to disputes over consent for the child to travel or to get documents.

What happens to residence after divorce?

Article 177, as summarized by Gulf Migration, says that if a divorced foreign custodian must change sponsors, the divorcer must arrange a suitable new sponsor, and if he refuses the court orders the transfer of her sponsorship. It also says the guardian may not cancel the sponsorship of a child under custody until the custody ends. The UK page adds that a divorced foreigner with no relative or employer to sponsor them may lose residency. Our guide to divorce in Qatar covers the process, and the family visa guide covers sponsorship.

Can a custodian mother travel with the child?

Article 185, per the same abstract, says a custodian mother may travel with her children to any destination if it poses no harm to them. If the guardian blocks the travel and the judge finds he abused his right, the judge intervenes. If the custodian is a foreigner visiting her home country, not moving there, the judge may require her sponsor to guarantee her return. If the guardian reasonably suspects she will not come back, he may seek a court injunction. A travel decree becomes enforceable three days after it is issued unless it is appealed. The UK page does not address children's exit permissions, so check whether you still need an exit permit.

Maintenance

The UK page says a husband is legally responsible for supporting his family, including housing, food, healthcare and children's education. If he refuses and claims he cannot pay without proof, a judge can give him up to three months before declaring the couple separated.

Practical steps

  • Keep copies of the custody order, the divorce decree and the child's documents.
  • Before travel, get a lawyer's view on whether the guardian's consent or a court order is needed.
  • Document attestation matters for foreign orders. See document attestation for Qatar.

What we could not verify

  • How the courts apply the travel rules in practice, or any Family Court guidance.
  • Whether the non-Muslim rules are applied the same way in every case.
