Non-Compete Clause in Qatar: What Is Allowed and for How Long

What Qatar's Labour Law says about non-compete clauses, why a lifetime ban is void, the two-year limit, and the rule against working for others while employed.

Under Labour Law Article 43, a clause that stops you working in your craft for life is void. A non-compete can apply after your contract ends only if your job lets you learn the employer's clients or business secrets, and it must be limited in time, place, and type of work, and not exceed two years.

A non-compete clause is one of the first things people ask about when they are offered a new job or want to leave. This guide follows Articles 42 and 43 of Labour Law No. 14 of 2004 as shown on Al Meezan, Qatar's official legal portal, which we read in October 2026. It covers workers under that law, and we list below what we could not check.

What a lifetime restriction means

Article 43 says that a condition in an employment contract is void if it includes an undertaking from the worker to work for life with the employer, or to abstain for life from any other craft or profession that could be practiced after leaving the job. The article applies even if the contract was signed before the law came into force.

When a non-compete is allowed

Article 43 allows a narrower restriction. If the nature of the work lets the worker know the employer's clients or the secrets of the business, the employer may set a condition that the worker will not compete with the employer or take part in a competing project after the contract ends. The article then limits it in four ways, which we set out below.

A clause that applies to every job, every country, and every year may go beyond what the article allows, but the articles do not say how a court measures that. If you are signing one, ask for the duration, area, and activity to be written precisely.

Working for others while you are employed

This is a separate rule. Article 42 sets out the worker's duties, and one of them is not to work for third parties, with or without payment. That applies while you are employed. So a second job or freelance work on the side can breach your contract and the law even if your employer has not mentioned it.

Confidential information

Article 42 also says the worker must not disclose the employer's secrets, even after the end of the contract. That obligation is separate from a non-compete. You can be free to take a competing job under Article 43 and still be bound not to share confidential information.

What to do before you sign

This is our own practical advice, not part of the law.

  • Read the clause and ask whether your role really gives you access to clients or secrets, because the article ties a non-compete to that.
  • Check the duration is not more than two years, and that the place and type of work are described, not left open.

Common mistakes

  • Assuming a non-compete is always void. It is allowed when Article 43's conditions are met.
  • Assuming it is always valid. A lifetime clause is void, and the permitted one is limited to two years.
  • Taking freelance work while employed without asking.
  • Mixing up the non-compete with the separate duty to protect secrets.

What we could not verify

  • Whether later amendments or ministerial decisions changed Articles 42 or 43. Al Meezan showed the 2005 text with no amendment notice when we read them.
  • How courts decide whether a clause is limited enough, or whether a penalty clause for breach is enforceable.
  • How these rules apply to free zones, public sector staff, or domestic workers.
