Can My Employer Keep My Passport in Qatar? What the Law Says
Article 8 of Law No. 21 of 2015 says an employer must give back your passport after residence procedures and whenever you ask, and Article 39 sets a fine. What it says and what to do.

Many workers hand over their passport on arrival and never see it again, because they are told it is company policy. This guide follows the Arabic text of Law No. 21 of 2015 on the entry, exit and residence of expatriates as shown on Al Meezan, Qatar's official legal portal, which we read in October 2026. We translated the articles ourselves, so check the Arabic on the portal if the exact wording matters to you.
What Article 8 says
Article 8 has three parts. First, every non-Qatari who lives in Qatar for any purpose needs a residence licence from the authority. Second, the person who brought the worker in, the sponsor, must complete the licence procedures and renew them within 90 days of the licence expiring. Third, and this is the part about passports, the employer must give the worker his passport or travel document after the licence or renewal procedures are finished, unless the worker asks the employer in writing to keep it for him, and the employer must then return it when the worker asks.
In plain terms, there are two ways an employer can lawfully hold your passport: only during the licence procedures, or because you asked in writing. A standing company rule that all passports are kept in the office is not what the article describes.

What the penalty is
Article 39 sets a fine of up to QR 25,000 for anyone who breaks the third part of Article 8, the passport rule. Article 40 sets a fine of up to QR 10,000 for breaking the first two parts, the licence and the 90-day renewal duty. Article 41 says a fine imposed under this law cannot be suspended. These are maximums set by the law; we did not find out how courts or the Ministry apply them in practice.
The Labour Law also covers your documents
Separately, Labour Law Article 53 says that at the end of the employment contract the employer must return to the worker the certificates and documents the worker deposited with them. So even where a passport was left with the employer by agreement, it should be handed back when the contract ends.
If you want your passport back
This is our own advice, not part of the law.
- Ask in writing. A short signed note or email that says you want your passport returned, with the date, is a good record.
- If you did ask the employer to keep it earlier, remember Article 8 says it must be returned when you ask.
- Keep a copy of your passport, residence permit and QID in a safe place before you hand anything over.

- If your employer says the passport is needed for residence work, ask when the procedure will be finished. Article 8 ties the handover to the end of that procedure.
Why people ask employers to keep it
Some workers choose to leave their passport with HR because the company handles renewals and visas for them. Article 8 allows this when you ask in writing. The risk is practical rather than legal: if you cannot travel or prove your identity quickly, you may need it back at short notice. - Handing over the passport with no written record of when or why.
- Assuming company policy overrides Article 8.
- Waiting until you want to travel before asking for it.
- Not keeping copies of your documents.
What we could not verify
- Whether later amendments, including Law No. 1 of 2017 and Decree-Law No. 19 of 2020, changed Article 8. The portal marks the law as in force, but we did not compare the amendments one by one.
- How the Ministry of Interior and the courts handle passport complaints in practice, and which office takes them first.
- Whether the fine applies differently to domestic workers or to workers outside the Labour Law.
- We read the Arabic text and translated it ourselves. We did not read an official English translation.
